Introduction to the Terms of Use Agreement

Welcome to Alluriv. This online store informs you that you will find below the terms and conditions governing your use of this store and all legal effects arising from your use of the store’s services through this online platform.

Any person’s use of the store—whether as a consumer purchasing a service or product, or otherwise—constitutes their full acceptance and approval, with full legal capacity recognized under Sharia, applicable regulations, and law, of all provisions and terms of this agreement, and confirms their commitment to comply with it.

This agreement applies to all types of transactions between the consumer and the store. This agreement becomes effective and enforceable immediately upon your acceptance and commencement of registration in the store, pursuant to Article (10) of the Saudi Electronic Transactions Law.

Article 1: Introduction and Definitions

The above introduction is an integral part of this agreement. The following are the key terms used herein:

  • Store: Includes all forms of the store on the internet, whether an application, a website, or a physical commercial outlet.
  • Consumer: A person who engages in e-commerce to obtain products or services provided by the store through its online platform.
  • Agreement: The terms and conditions of this agreement governing and regulating the relationship between its parties.

Article 2: Consumer’s Legal Capacity

The consumer acknowledges having legal capacity recognized under Sharia and applicable regulations to deal with the store, and that their age is not less than eighteen (18) years.

The consumer agrees that if they violate this article, they shall bear the consequences of such violation toward third parties.

Article 3: Nature of the Store’s Commitment

The store’s obligation toward consumers is to provide the service or product.

The store may provide other services such as after-sales services or related services, depending on the nature and type of the requested service or product.

Article 4: Platform Use Guidelines

The consumer shall use the store’s online platform in accordance with public morals and the applicable regulations in the Kingdom of Saudi Arabia.

When purchasing a service or product from this store, the consumer shall not use such service or product in any manner that violates public morals or the applicable regulations in the Kingdom of Saudi Arabia.

Article 5: Accounts and Registration Obligations

Upon applying for membership as a user of this store, you must disclose certain information and choose a username and a confidential password to access the store’s services. By doing so, you agree to the following:

  • You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the store of any unauthorized use of your account or any breach of your confidential information.
  • The store shall not, under any circumstances, be liable for any loss you may suffer, directly or indirectly, whether moral or material, resulting from disclosure of the consumer’s name or login credentials.
  • You agree to use your account or membership personally and you bear full responsibility for it. If someone else uses it, this will be deemed evidence that you authorized them to use the store in your name and for your account.
  • You agree to use the store with seriousness and honesty.
  • You agree to provide true, accurate, up-to-date, complete, and lawful information about yourself as required during registration, and to update your data whenever it changes or when needed.
  • The store commits to handling your personal information and contact details with complete confidentiality.
  • If the store discovers that you provided information that is false, inaccurate, not current, incomplete, unlawful, or in violation of these Terms of Use, the store has the right to suspend, freeze, or cancel your membership or account on the platform without prejudice to the store’s other legal rights and remedies.
  • If you fail to comply with any of the above, the store management has the right to suspend or cancel your membership or account or block your access to the store’s services.

Article 6: Electronic Communications and Official Channels

The parties agree that communication will take place via the email registered on the platform.

The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall have the same legal effect as written documents and shall independently satisfy legal and Sharia requirements.

The consumer agrees that the store management may contact and notify them regarding provisions of this agreement or related dealings by broadcasting general messages to all consumers or to specific users of the store.

Article 7: Amendments to the Terms of Use and Fees

If any article or clause of this agreement is cancelled or becomes unenforceable, this shall not affect the validity of the remaining articles and clauses, which shall remain in force until further notice from store management.

This agreement, which may be amended from time to time as necessary, forms the working mechanism, understanding, and agreement between the consumer and the store.

The store may impose fees on certain consumers depending on offers, products, or services they request, or based on fees or taxes imposed by the state related to the nature of the product or service.

The store reserves the right to add, increase, reduce, or discount any fees or expenses under these Terms of Use for any consumer, for any reason related to their registration.

Article 8: Payment and Settlement Services

The store, through its partners, provides payment and settlement methods which may be completed online via available payment options on the store, or through any payment method the store may offer from time to time.

The store is obligated to set the price of the service or product it offers in accordance with commonly recognized market value.

The store is obligated to provide invoices, receipts, and proof of collection or receipt for all amounts and earnings generated through the store, and to provide the consumer with an invoice for their purchase.

The store is obligated to provide recognized accounting standards on its e-store in accordance with this agreement, due to the legal, economic, commercial, and organizational interests of such regulation.

Article 9: Intellectual Property

The store’s intellectual property rights are fully owned by the store, whether owned before or after establishing this online platform.

The consumer respects the store’s intellectual property rights, including the store name, words, logos, symbols, and other marks belonging to or displayed on the store. All rights associated with the store name are fully owned by the store.

Article 10: Store Responsibility

The store commits to conducting its business through this platform in accordance with applicable regulations in the Kingdom of Saudi Arabia and in accordance with this agreement.

The store shall not be liable for any claims arising from errors or negligence, whether direct or indirect, incidental, caused by the consumer or by a third party such as shipping companies.

Alluriv, its staff, owners, and representatives commit that the product or service is lawful, legitimate, authorized under the laws and regulations of the Kingdom of Saudi Arabia, and used for lawful purposes.

Article 11: Restriction of Access or Membership

The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform services at any time, without prior notice, for any reason, without limitation.

Article 12: Governing Law

These Terms of Use are governed and drafted in accordance with the laws, regulations, and legislations in force in the Kingdom of Saudi Arabia, and are fully subject to the applicable rules of the competent authorities in Saudi Arabia.

Article 13: General Provisions

If any article or clause in these Terms of Use is cancelled or becomes unenforceable, this shall not affect the validity of the remaining articles, clauses, and provisions, which shall remain in force until further notice from store management.

These Terms of Use, which may be amended from time to time as necessary, constitute the Terms of Use and the mechanism of work, understanding, agreement, and contracting between the store and the consumer.

Both parties agree to consider the following:

  • Arabic is the official language used when interpreting the provisions of this agreement, or when translating it into another language.
  • All prices displayed for the store’s services or products may be changed from time to time.
  • Promotional or marketing offers provided by the store are temporary; the store has the right to amend or stop such offers at any time.
  • The parties shall deal with each other in a manner that does not violate Sharia rules or the applicable laws and regulations related to the nature of the relationship between the store and the consumer.
  • These Terms of Use shall not be cancelled except by a decision issued by the store management.
